Welcome to CanvasMalta.com (the “Site”). The Site is owned and operated by Gozo Graphics Ltd. (“Gozo Graphics”, “we”, “us”, “our”). By using the Site you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please refrain from using the Site. We may update these Terms from time to time without prior notice. Continued use of the Site constitutes acceptance of the updated Terms. Section A sets out the Terms and Conditions (including order and website use); Section B sets out our Privacy Policy for CanvasMalta.com.

Section A — Terms and Conditions

1) CanvasMalta Orders & Quality

• All CanvasMalta products are custom-made using the image(s) and options you provide via the Site.
• If your canvas arrives damaged, defective, or significantly different from the description, contact Customer Service at canvasmalta@gozo.graphics or +356 9933 6964 within 7 days from delivery or collection, with photos and your order number.
• We may, at our discretion, reprint or refund the affected item(s). This does not cover circumstances listed under clauses 1.1 and 1.2 below.

1.1) File Submissions — Exclusions

• Spelling, punctuation, or grammatical errors made by you in text or captions.
• Inferior quality, compression artefacts, or low-resolution of uploaded images.
• Design errors or colour selection errors introduced in your artwork.
• Errors in user-selected options (product type, size, orientation, quantity, cropping or positioning in the live preview).
• Incorrect dimensions, image orientation, or files not meeting CanvasMalta specifications.
• Colour expectations based solely on on-screen views where no hardcopy proof or sample was approved.
• Delivery delays due to improperly prepared or corrupted files.
• Duplicate orders submitted by the customer.

1.2) Shipping and Delivery — Exclusions

• Incorrect delivery address, undeliverable packages, or failed attempts caused by inaccurate or incomplete details provided by you.
• Damage to products arising after delivery to you or after collection from our outlets.
• We are not responsible for any indirect loss, business loss, or consequential damages resulting from receiving products later than the estimated date.
• We may require return or photographic evidence of the original order before reprinting or refunding.

2) Payment

• Prices are in Euros (€) and include VAT where applicable.
• By submitting an order, you agree that the total amount (including any applicable taxes and charges shown at checkout) will be charged to your selected payment method.
• Orders enter production only once payment has been successfully completed.
• Because products are custom-made, no changes to image, size, or options are possible after payment is completed.

2.1) Approved Payment Methods

• Payment via our online payment gateway (currently Revolut Payment Gateway or any replacement we list at checkout).
• Other methods, if any, will be shown on the Site at checkout from time to time.

2.2) VAT Policy

Gozo Graphics Ltd. is required to collect and remit VAT on all taxable sales. The applicable VAT (currently 18% on standard-rated products) is included in the price shown at checkout. Fiscal receipts or invoices are provided with delivery, collection documentation, or via email once payment is effected.

2.3) Late/Non-Payment & Remedies

For CanvasMalta.com, orders are generally produced only after full payment is received. If any amount remains unpaid for special arrangements or manual orders, we may suspend production, withhold deliverables, and postpone any shipment or collection until payment is received. Where applicable and to the fullest extent permitted by law, we may take lawful steps (including court proceedings) to recover sums due, together with any court-awarded costs and statutory interest. Nothing in this clause transfers ownership of your pre-existing intellectual property.

3) Colour Accuracy and Live Previews

• We reproduce colour from submitted files as closely as reasonably possible, but exact matches cannot be guaranteed due to printing limitations, substrate characteristics, and neighbouring ink requirements.
• Colour may differ between your device screen and the physical canvas because screens are backlit and individually calibrated (or uncalibrated).
• For critical colour work, you should contact us before ordering to discuss proofing options or technical recommendations.

3.1) Binding Proof Standard

Where a physical sample or hardcopy proof is expressly provided and approved in writing, that sample (not screenshots or PDFs) is the only colour reference we treat as binding for tolerance purposes. On-screen previews alone are not binding proofs.

3.2) Live Content Previews

Any live or on-screen product previews on CanvasMalta.com are indicative only and may differ from the final physical product due to device display settings, print processes, substrate characteristics, and finishing tolerances. Previews are not colour-accurate proofs and are subject to change on the finished product.

4) Artwork Files & Uploaded Images

• You are responsible for the accuracy and suitability of your uploaded files and must review the live preview carefully before placing an order.
• You certify that you have all necessary rights, licences, and permissions to use the image(s) and content you upload for printing.
• You must not upload content that is unlawful, defamatory, hateful, or that infringes privacy, publicity, copyright, or other intellectual property rights without permission. We reserve the right to refuse orders that we reasonably consider to breach these rules.
• Do not send irreplaceable originals by post or courier; we are not responsible for loss or damage to physical originals.
• We will not sell client-submitted images/artwork to other customers. However, with your prior consent, images of finished products may be used for marketing campaigns, advertising, and social media posts.

5) Production & Materials (CanvasMalta)

• CanvasMalta products are printed on 280 gsm matte art-grade polyester canvas using HP Latex 4th Generation inks (or equivalent technology), then hand-stretched over approximately 2 cm sustainable pine frames.
• Canvas edges are produced with a mirrored edge effect by default; other edge styles (e.g. solid colour or image stretch) are not offered via CanvasMalta.com unless explicitly stated.
• Minor variations in colour, stretch tension, and alignment may occur due to manual processes and material tolerances.

6) Turnaround, Delivery & Collection

• Typical production and delivery/collection timeframe is 7–10 working days from order confirmation, but this may vary depending on order volume and product type.
• Once your order is ready for collection, you will receive a “Ready for Collection” email with details.
• We offer free standard delivery to addresses in Malta and Gozo on every order placed via CanvasMalta.com.

6.1) Collection Locations

6.2) Packaging Transparency

All CanvasMalta canvases are usually packaged in clear plastic so the print is fully visible upon collection or delivery. CanvasMalta.com does not offer opaque, gift-wrapped, or otherwise discreet packaging.

6.3) Processing & Delivery Estimates

All processing times, dispatch dates, and delivery dates shown on the Site or in communications are estimates and may vary by product and order complexity. Estimated dates are not guaranteed and exclude delays outside our control (e.g. carrier issues, weather events, supply interruptions).

7) Miscellaneous (Orders)

• All CanvasMalta sales are final once production begins, except as required by law or as expressly stated in these Terms.
• Because canvases are produced to your specifications, no returns for change of mind are accepted.
• Your printed product or images will not be used in marketing without your prior consent, except as described in clause 4 regarding finished product images.

8) Force Majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, labour disputes, supply interruptions, carrier failures, governmental actions, or utility outages.

9) Limitation of Liability (Orders)

IN NO EVENT WILL GOZO GRAPHICS LTD, INCLUDING ITS CANVASMALTA.COM WEBSITE, BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR OTHER DAMAGES, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. GOZO GRAPHICS LTD’S ENTIRE LIABILITY UNDER, FOR BREACH OF, OR ARISING OUT OF PROVIDING THE SERVICES HEREUNDER IS LIMITED TO A REFUND OF THE FEES PAID FOR THE PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM. IN NO EVENT SHALL GOZO GRAPHICS LTD BE LIABLE FOR YOUR COST OF PROCURING SUBSTITUTE GOODS.

10) Indemnity (Orders)

You will defend and hold Gozo Graphics Ltd and CanvasMalta.com harmless from claims, costs, expenses (including reasonable attorneys’ fees), liabilities, or losses arising from our use (acting as your agent) of copy, photographs, or illustrations alleged to be degrading, libellous, or harmful, or to infringe intellectual property rights; or from actions of your employees or other third parties resulting from any distribution or use of products you order.

11) Website Use & General Terms

• The following clauses govern your general use of CanvasMalta.com and should be read together with the order-related clauses above and the Privacy Policy in Section B.

11.1) Copyright Notice

All Site content (the “Content”) is the intellectual property and copyrighted works of Gozo Graphics Ltd and/or third-party providers (“Providers”). Reproduction or storage is subject to the Copyright Act (Maltese law) and other applicable legislation.

11.2) Corporate Identification and Trademarks

“Gozo Graphics”, “CanvasMalta”, “CanvasMalta.com”, and related marks and logos are trademarks or trade names of Gozo Graphics Ltd in Malta. You may not use, copy, or modify them without our prior written consent. Use as a “hot” link requires pre-approval.

11.3) Use Restrictions

• Use the Site only to make legitimate purchase requests (“Requests”); do not make speculative, false, or fraudulent Requests.
• No robots, scrapers, or other automated means of access unless specifically permitted by us in writing.
• You represent that you are of sufficient legal age to use the Site and to enter into binding contracts, and that you will keep your information current, complete, and accurate.
• Placing a Request in a false name or with invalid payment details is unlawful and may be reported to the relevant authorities.
• Permission is granted to copy/print portions of the Site solely as a shopping resource; all other use requires prior written consent from Gozo Graphics Ltd.

11.4) Email

We may not respond to all submissions. We assume no responsibility for reviewing unsolicited ideas and have no liability for any similarities between such submissions and future programs or services. You are responsible for the material you submit. Do not reveal trade secrets or confidential information via the Site. All rights to materials and ideas submitted become Gozo Graphics Ltd’s exclusive property.

11.5) Privacy Reference

Your use of the Site is also governed by our Privacy Policy in Section B. By using the Site, you confirm that you have read and agree to that Policy.

11.6) Disclaimer of Warranty

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. OPERATION OF THE SITE MAY NOT BE UNINTERRUPTED OR ERROR-FREE.

11.7) General Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOZO GRAPHICS LTD (INCLUDING CANVASMALTA.COM) AND ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AFFILIATES (“COVERED PARTIES”) ARE NOT LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR CONNECTED WITH USE OF THIS SITE OR DELAY/INABILITY TO USE THIS SITE, EVEN IF ADVISED OF THE POSSIBILITY. IF A COVERED PARTY IS FOUND LIABLE, LIABILITY SHALL NOT EXCEED THE FEE OR CHARGE ASSESSED BY GOZO GRAPHICS LTD FOR THE RELEVANT REQUEST OR ORDER.

11.8) Indemnification

You agree to defend, indemnify, and hold harmless Gozo Graphics Ltd, CanvasMalta.com, and their affiliates from any and all claims, damages, costs, and expenses (including attorneys’ fees) arising from or related to your use of the Site, your breach of these Terms, or your infringement of any rights of a third party. You certify that you own or are licensed to use images reproduced as part of your order.

11.9) Third Parties

If you submit Requests for or on behalf of a third party, you are responsible for the accuracy of the information provided and must inform the third party of these Terms and any applicable rules or restrictions. You agree to indemnify the Covered Parties for failures by you or the third party to fulfil obligations under these Terms. You are directly responsible for any Request submitted, including all fees, charges, and performance.

11.10) User Comments, Feedback, and Other Submissions

All comments, feedback, suggestions, and ideas (“Comments”) submitted via the Site become Gozo Graphics Ltd’s exclusive property and may be used worldwide in any medium without your specific consent. We have no obligations to maintain confidentiality, pay compensation, or respond to Comments.

11.11) Links to Other Websites and Services

Third-party links are provided for convenience only. We do not guarantee their accuracy or completeness and are not responsible for their content, security, or privacy practices. Your use of such third-party sites is at your own risk.

11.12) Termination of Usage

Access to all or part of the Site may be terminated or suspended at any time, without notice and for any reason, including but not limited to breach of these Terms.

11.13) Miscellaneous

Captions are for convenience only and do not limit or affect the interpretation of these Terms. The Covered Parties are not responsible for errors or delays caused by incorrect email addresses, technical problems, or other issues beyond their reasonable control.

11.14) Entire Agreement

These Terms, together with the Privacy Policy in Section B and any other terms incorporated by reference, form the entire agreement between you and Gozo Graphics Ltd regarding your use of CanvasMalta.com and supersede all prior understandings. We may amend these Terms by posting an updated version on the Site. If any provision is held invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect.

11.15) Governing Law and Jurisdiction

The laws of Malta govern these Terms. You consent to the exclusive jurisdiction and venue of the courts located in Victoria, Gozo, Malta for any disputes arising out of or relating to these Terms or your use of the Site.

Section B — Privacy Policy (GDPR-Aligned)

This Privacy Policy explains how Gozo Graphics Ltd (“we”, “us”, “our”) collects and processes personal data when you use CanvasMalta.com, and explains your rights under the EU/EEA GDPR and Maltese law. This version consolidates and clarifies our policy for CanvasMalta.com while adding required GDPR disclosures.

2) Scope and Definitions

This Policy applies to personal data processed when you visit or use CanvasMalta.com, place an order, contact us, or interact with our marketing and analytics tools. Terms such as Personal Data, Processing, Controller, Processor, Third Party, Affiliate, and Service Provider have the meanings given in the GDPR. “Account” refers to any account you create to access parts of the Service.

3) Categories of Personal Data We Process

• Identification & contact: full name, email, phone/telephone number, postal address (including town/city/county/region/postcode), country.
• Demographic data (where provided): e.g. gender, date of birth.
• Account data: login credentials and preferences (if you create an account on CanvasMalta.com).
• Order & transaction data: products/services purchased, payment status (we do not store full card details on our servers), invoices, VAT details.

4) Purposes and Legal Bases

• Provide/maintain the Service (including accounts) and produce orders: Art. 6(1)(b) GDPR (contract); Art. 6(1)(f) (legitimate interest in quality, efficiency, and fraud prevention).
• Process and fulfil orders; customer support; manage requests: Art. 6(1)(b) GDPR (contract).
• Service messages and security updates (e.g. order confirmations, important changes): Art. 6(1)(b) (contract) and, where relevant, Art. 6(1)(c) (legal obligation).

4.1) Handling of Personally Uploaded Files

Files you upload to CanvasMalta.com (including images for printing) are used to provide and support the Service, such as producing your order, handling quality claims, and facilitating reprints. Files are accessible only to authorised personnel and trusted Service Providers where strictly necessary. We may perform periodic housekeeping to optimise storage, during which older uploads may be deleted. If you want a specific file removed, you may request deletion at any time by emailing info@gozo.graphics or canvasmalta@gozo.graphics and identifying the file(s). We will honour your request unless we must retain the file to comply with legal obligations (e.g. accounting, fraud prevention, or lawful claims). This supports your GDPR right to erasure where applicable.

4.2) AI-Assisted Processing of Files

To provide and improve print quality (for example upscaling, denoising, artefact removal, background cleanup, and colour correction), we may use third-party AI/ML tools as part of our production workflow. By uploading files and placing an order, you grant Gozo Graphics Ltd (including CanvasMalta.com) a non-exclusive, worldwide licence to process your files for the purpose of producing your order and providing related support, which includes using such AI tools as processors under contractual safeguards. We require our service providers to act on our instructions and do not permit them to use your content to train their models or for their own purposes, unless you explicitly consent or choose an integration that states otherwise.

Subject to applicable law, Gozo Graphics Ltd (including CanvasMalta.com) is not liable for acts or omissions of independent third-party providers beyond our reasonable control, provided we have taken appropriate steps to engage them under GDPR-compliant contracts and safeguards.

5) Cookies and Similar Technologies

We use session and persistent cookies and similar technologies, including necessary/essential, preference/functionality, statistics/analytics, and (where you consent) advertising/marketing cookies, as explained in our Cookie Policy. Where cookies are not strictly necessary (such as analytics, advertising, or marketing cookies), we request your consent through our cookie banner/controls and store your preferences using consent-management cookies (for example cmplz_*), typically retained for up to 365 days.

About Cookie Controls & Third-Party Plugins

We use a consent-management platform to control non-essential cookies. You can withdraw or change your cookie consent at any time via our Cookie Policy page or by clearing cookies in your browser. If a third-party component fails or is blocked, previously given consent on your device or browser profile may still allow certain embeds or pixels to load until you change your preferences. 6) Sharing of Personal Data

• Note: Data sent to advertising/analytics partners may involve international transfers outside the EU/EEA; we rely on appropriate safeguards (e.g. Standard Contractual Clauses) and obtain your consent before setting non-essential cookies or pixels.

7) International Data Transfers

Personal data may be processed in Malta and in other countries where our Service Providers are established. For transfers outside the EU/EEA, we implement appropriate safeguards required by the GDPR (for example European Commission Standard Contractual Clauses) and additional measures where necessary.

8) Retention

We retain personal data only as long as necessary for the purposes set out in this Policy, including compliance with legal obligations (e.g. tax/accounting), dispute resolution, and enforcement of our agreements. Usage data may be retained for a shorter period unless needed to improve security or functionality, or required by law. Uploaded files may be retained for a limited operational period (for example to support reprints or handle claims) and may later be deleted as part of housekeeping.

9) Your GDPR Rights

• Data Portability (Art. 20) where technically feasible and applicable.
• Object (Art. 21) to processing based on legitimate interests and to direct marketing (including related profiling).
• Withdraw consent at any time where processing is based on consent (Art. 7(3)); this does not affect the lawfulness of processing before withdrawal.

9.1) Automated Decision-Making & Profiling

We do not make decisions that produce legal or similarly significant effects about you solely by automated means. We may use limited profiling (for example to tailor marketing or measure campaign effectiveness) only where you have consented to analytics/advertising cookies. You can withdraw that consent at any time via our Cookie & Privacy controls (see the Cookies section).

10) Children’s Privacy

• The Service is not directed to children under 13, and we do not knowingly collect their personal data.
• If you are a parent or guardian and believe a child has provided personal data via CanvasMalta.com, please contact us so that we can investigate and delete the data where appropriate.
• We may limit processing of users aged 13–18; where consent is required by law, parental consent may also be required.

11) Security

We use commercially reasonable technical and organisational measures to protect personal data; however, no method of transmission or storage is 100% secure. You are responsible for keeping your account credentials confidential and for any activity under your account.

12) Links to Other Websites

Third-party websites linked from CanvasMalta.com are not operated by us. We are not responsible for their content, security, or privacy practices. We recommend that you review the privacy policies of any third-party sites you visit.

13) Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post updates on this page and update the “Last updated” date at the top of the Terms & Privacy page. Where required by law, we will also provide additional notice of material changes.
